as the law stands, however, this does not limit how alpr data can be used, only how long police can keep it. notably, new york’s statute applies only to the use of any device that “captures or receives images, sounds or data of any type from any street vehicle in the state for the purpose of determining, or assisting in determining, any agency, department or entity of the government of the state or of any political subdivision thereof.” footnote12_5n2if4f 11 section 250-h(2). these include images captured in license plate reader devices, as well as towed or handheld devices that capture images. so, while city and state police will still be able to use the data to run lists of stolen and unregistered vehicles in the state, the data collected will be bound by the same rules as the vast majority of the street-based cameras every day.
